Terms of Service
The agreement between you and XXXscroll for using the site, its paid features and creator tools.
1. About these Terms
These Terms of Service (the "Terms") are a binding agreement between you and XXXscroll, the operator of XXXscroll at https://xxxscroll.com, including its Hentai Reels section at https://xxxscroll.com/hentai (together, the "Site"). "We", "us" and "our" mean XXXscroll. "You" means anyone who visits, browses, registers on or otherwise uses the Site, including viewers, members and creators.
One XXXscroll account works across the whole Site, but the main site and Hentai Reels each have their own content, and purchases, subscriptions and creator earnings are kept separately for each.
By accessing or using the Site you confirm that you have read, understood and agree to these Terms and to the documents they incorporate:
- the Privacy Policy
- the Cookies Policy
- the Acceptable Use Policy
- the Payments & Refunds Policy
- the Creator Terms (if you upload content or earn on the Site)
- the Copyright & DMCA Policy
- the Complaints & Appeals Policy
- the Age Verification & Records Compliance Statement
If you do not agree, you must not use the Site.
2. Adults only
The Site contains sexually explicit material, including (on Hentai Reels) animated, illustrated and computer-generated material. You may only use the Site if:
- you are at least 18 years old, and at least the age of majority where you live and where you access the Site (if that is higher than 18);
- viewing sexually explicit material is lawful where you are, and you are choosing to view it;
- you will not let any minor see or access the Site through your device or account; and
- you are not barred from using the Site under any applicable law or by a previous decision of ours.
We may ask you to confirm your age at any time, and we may use age-assurance tools where the law requires them. If we learn or reasonably suspect that a user is under 18, we will close the account and remove their content. Parents and guardians can use parental-control tools to block adult sites; the Site is labelled for such tools.
3. Your account
- Registration. Some features need an account: liking, saving, following, commenting, subscribing, unlocking paid posts, the wallet, Premium and uploading. You must give accurate information and keep it up to date. Your email address must be verified before some features work.
- One person, one account. Accounts are personal. Do not share, sell, rent or transfer an account, and do not create accounts to get around a restriction, a ban or a limit.
- Security. You are responsible for keeping your password secret and for all activity under your account. Tell us at [email protected] straight away if you think your account has been compromised.
- Usernames and profiles. Do not use a name, avatar or bio that impersonates someone else, infringes another person's rights, or is offensive or misleading. We may change or remove any of these.
- Security checks. To protect the Site and its users we run automated security and anti-abuse checks on requests, such as device and session checks, proof-of-work challenges, rate limits and bot detection. Do not try to bypass them.
4. Roles on the Site
- Visitors may browse public content without an account.
- Members are registered users who can interact with content and buy access to paid content.
- Creators are members who upload content. Creators who want to charge for content must first pass identity and age verification. Creators must also accept the Creator Terms, which add to these Terms.
5. Licence to use the Site
We give you a personal, limited, non-exclusive, non-transferable and revocable licence to access and view the Site and its content for your own private, non-commercial use, as long as you follow these Terms.
Except through features the Site itself provides, you may not:
- copy, download or record any content;
- screen-capture content for redistribution;
- scrape or re-upload content;
- sell, publicly display or otherwise exploit content.
Unlocking a paid post or subscribing to a creator gives you a licence to view that content on the Site. It does not give you ownership of the content or any right to redistribute it.
All software, design, text, logos and trademarks of the Site belong to us or our licensors. Any rights not expressly granted to you are reserved.
6. Content you post
"User Content" means anything you upload, post or send through the Site: videos, images, captions, tags, comments, ratings, profile details, avatars and messages.
- You keep ownership of your User Content.
- Licence to us. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, process, adapt (for example to resize, transcode, create thumbnails, blurred previews and short preview clips), translate, display, distribute and promote your User Content. The licence lets us operate, improve, secure and market the Site, and it covers moderation and legal compliance. It ends when you delete the content or your account. It continues for:
- copies kept for legal, safety or record-keeping reasons, and backups held for a limited time;
- content that other users have already lawfully unlocked, which stays available to them after you delete it, unless we removed the content for breaking our rules (see the Creator Terms).
- Your promises. For all User Content, you confirm that:
- you own it or have every right, licence, consent and release needed to post it and to grant the licence above;
- every person shown in it was 18 or older when it was made, consented to being recorded, and consented to it being published on the Site, and you hold records proving this;
- it is lawful where it was made and where it is published, and it follows the Acceptable Use Policy.
- Edits. A post's caption and tags can only be changed for 3 hours after it is posted. This protects members who liked, commented on or paid for it. Price and paywall settings work as described in the Creator Terms.
- No obligation to host. We may refuse, remove, restrict, blur, age-gate, quarantine or preserve any User Content at our discretion, including when we act on automated detection, user reports, legal requests or our own review.
7. Paid features
The Site offers paid features:
- Unlocking individual paid posts (pay-per-view), paid from your wallet balance.
- Creator subscriptions, paid from your wallet balance. A subscription gives access to the creator's subscriber content for the period shown at purchase.
- Premium membership, paid in a supported cryptocurrency. It gives you the Premium benefits described on the Premium page for the plan period you choose.
You add funds to your wallet with supported cryptocurrencies. Before you confirm any purchase, the price is shown in US dollars. Purchases, subscriptions, the wallet and refunds are governed by the Payments & Refunds Policy, which forms part of these Terms.
Wallet balance is prepaid credit for use on the Site only. It is not a bank deposit, e-money, a security or a cryptocurrency. It earns no interest and it cannot be withdrawn, transferred to another user or exchanged for cash, except where the law requires otherwise.
8. Rules of conduct
You must follow the Acceptable Use Policy at all times. In particular, you must not:
- post or request illegal content of any kind, including any sexual content involving minors. This includes drawn, animated or AI-generated depictions of characters who are, or appear to be, minors;
- post content without the consent of every person shown in it;
- harass, threaten, dox, defraud or impersonate anyone;
- interfere with the Site, for example by scraping, using bots, overloading it, bypassing the paywall or security checks, or exploiting bugs;
- misuse payments, reporting tools or the referral programme.
9. Moderation and enforcement
We use a mix of automated tools and human review to keep the Site safe. These include media scanning, hash matching against known illegal material, banned-word filters and user reports. If you break these Terms, or we reasonably believe you have, or we must act to protect users, third parties, the Site or ourselves, we may do any of the following:
- remove, hide, restrict or quarantine content;
- issue a warning or limit features;
- suspend the account temporarily or permanently, or ban it;
- block IP addresses or devices;
- withhold, reverse or forfeit creator earnings as described in the Creator Terms;
- preserve evidence and report to law enforcement, the National Center for Missing & Exploited Children (NCMEC) or other competent authorities.
Where the law requires it, we will tell you what we decided and why, and how to challenge the decision under the Complaints & Appeals Policy. We may not notify you where doing so would be unlawful, would compromise an investigation, or concerns spam or child sexual abuse material.
Suspected child sexual abuse material and other seriously illegal content is removed immediately. It is preserved under legal hold for the period required by law and reported to the authorities. It is never returned to the uploader.
10. Ending your use of the Site
You may stop using the Site at any time and ask us to delete your account by writing to [email protected] from the email address on the account. When an account is closed:
- unused wallet balance is forfeited, unless the law requires a refund;
- access to unlocked posts and subscriptions ends;
- we keep the records we are legally required or permitted to keep, as described in the Privacy Policy.
We may suspend or close your account, with or without notice, under Section 9 or if the Site or a feature is discontinued. If we close the Site or a paid feature for reasons that are not your fault, we will handle unused balances fairly and as the law requires.
11. Third parties
The Site may show advertising and sponsored content. It may also link to, or rely on, services we do not operate, such as public blockchain networks and the crypto wallets you use to pay. We are not responsible for third-party services, their content or their terms. Cryptocurrency transactions are processed by public blockchain networks that we do not control.
12. Disclaimers
To the fullest extent permitted by law, the Site and all content are provided "as is" and "as available". We give no warranty of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, availability, accuracy or that the Site will be uninterrupted, secure or free from errors or harmful components.
User Content belongs to the users who post it. It does not represent our views, and we do not endorse it or verify it before publication.
Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded by contract.
13. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages. We are also not liable for any loss of profits, revenue, data, goodwill or cryptocurrency arising from or related to the Site or these Terms, even if we were told such loss was possible.
- Our total liability for all claims relating to the Site or these Terms is limited to the greater of:
- the amount you paid into your wallet in the 12 months before the event giving rise to the claim; or
- US$100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited under applicable law.
14. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless XXXscroll and its affiliates, officers, staff and contractors from any claims, losses, liabilities, damages, fines, costs and expenses (including reasonable legal fees) arising from:
- your User Content;
- your use or misuse of the Site;
- your breach of these Terms; or
- your violation of any law or of the rights of any third party (including the rights of any person shown in your content).
15. Disputes and governing law
The Site is offered to users worldwide. We want disputes to be resolved fairly and in a way that works in every country where the Site is lawfully available.
- Talk to us first. Before starting any formal claim, please contact [email protected] with a description of the problem. We will try in good faith to resolve it informally within 60 days.
- Your local law. If you are a consumer, you keep the protection of the mandatory laws of the country where you live. You may bring proceedings in the courts of that country where its law gives you that right.
- Otherwise, these Terms and any dispute about them are governed by generally recognised principles of contract law, interpreted fairly and in good faith. Where the law allows, a dispute that cannot be resolved informally will be finally resolved by confidential, binding arbitration conducted online in English by a single arbitrator. Either party may instead bring an individual claim in a small-claims court with jurisdiction.
- Individual claims only. Where the law allows, claims may only be brought individually and not as a plaintiff or class member in any class, collective or representative proceeding.
- EU users. You can also use the out-of-court dispute settlement bodies described in the Complaints & Appeals Policy for moderation decisions.
Nothing in this section prevents either party from seeking urgent injunctive relief to protect intellectual property, confidential information or the safety of any person.
16. Changes
We may update these Terms, for example to reflect new features, legal requirements or how the Site works. When we do:
- we will post the updated Terms with a new "Last Updated" date;
- for material changes, we will give reasonable advance notice on the Site or by email, unless a change is needed urgently for legal or safety reasons.
If you keep using the Site after the changes take effect, you accept them. If you do not agree, you must stop using the Site.
17. General
- Entire agreement. These Terms, together with the documents listed in Section 1, are the whole agreement between you and us about the Site.
- Severability. If any provision is found invalid or unenforceable, it will be limited to the minimum extent necessary and the rest will stay in force.
- No waiver. If we do not enforce a right, that is not a waiver of it.
- Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours as part of a reorganisation, merger or sale, or to an affiliate, without reducing your rights.
- Force majeure. We are not responsible for failures caused by events beyond our reasonable control. These include network or blockchain outages, attacks, natural events and actions by authorities.
- Language. If these Terms are translated, the English version prevails to the extent permitted by law.
- Notices. We may send you notices through the Site or to your account email. You can reach us at [email protected].
18. Contact
For support, legal notices, abuse reports and copyright matters, email [email protected]. Please put the topic in the subject line.
