Copyright & DMCA Policy
How to report copyright infringement on XXXscroll, how counter-notices work, and our repeat-infringer policy.
1. Our approach
XXXscroll respects intellectual-property rights and expects users to do the same. We respond to clear notices of alleged infringement under:
- the US Digital Millennium Copyright Act (17 U.S.C. § 512, the "DMCA");
- the EU Digital Services Act; and
- similar laws elsewhere.
Uploading content you do not own or do not have permission to use is prohibited.
2. Sending a takedown notice
Send your notice to [email protected] with the subject "Copyright". It must include:
- your physical or electronic signature, or that of a person authorised to act for the rights holder;
- a description of the copyrighted work you say is infringed. If there are several works, include a representative list;
- the exact URL(s) on XXXscroll of the material you want removed, and enough detail for us to find it;
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law;
- a statement that the information in the notice is accurate, and, under penalty of perjury, that you are the rights holder or authorised to act for them.
Notices that do not meet these requirements may be rejected or delayed. Please do not use this process for privacy, impersonation or non-consensual content complaints. Use the Report Abuse page, which is faster for those issues.
3. What happens next
- We remove or disable access to the material promptly once we receive a valid notice.
- We tell the uploader, and send them a copy or summary of the notice, which may include the complainant's name and contact email.
- Sales of removed content stop. The creator's earnings from infringing content may be reversed, as set out in the Creator Terms.
4. Counter-notices
If you believe your content was removed by mistake or misidentification, you can send a counter-notice to [email protected] with the subject "Counter-notice". It must include:
- your physical or electronic signature;
- a description of the material that was removed and the URL where it appeared;
- a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification;
- your name, address and telephone number;
- a statement that you consent to the jurisdiction of the courts for the judicial district where your address is (if you are in the United States), or for any judicial district in which XXXscroll may be found (if you are outside the United States);
- a statement that you will accept service of process from the person who sent the original notice, or their agent.
We forward valid counter-notices to the complainant. Unless the complainant tells us within 10 to 14 business days that they have filed a court action, we may restore the material. Rights under the EU DSA to challenge a removal are described in the Complaints & Appeals Policy.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe. Two or more valid notices against an account will normally lead to a permanent ban and forfeiture of earnings from infringing content.
6. Misrepresentation
Anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages, including costs and legal fees, under 17 U.S.C. § 512(f) and similar laws. We may ignore notices from senders who repeatedly submit unfounded notices.
7. Other intellectual-property and personal-rights claims
For trademark, publicity-rights or other IP complaints, write to [email protected] with the same level of detail.
If you appear in content without your consent, do not use the copyright process. Report it immediately as non-consensual content, as described on the Report Abuse page.
