DMCA & Copyright Policy
Our policy and procedures for reporting copyright infringement under the DMCA.
Website: https://xxxscroll.com and https://xxxscroll.com/ads (“Site,” “we,” “us,” “our”)
1. Overview & Policy Statement
xxxscroll.com respects the intellectual property rights of content creators, copyright owners, and authorized distributors. We comply with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512 / DMCA) and other applicable international copyright laws.
Third-Party Content Indexing Notice
xxxscroll.com operates strictly as a search index, catalog, and directory service. We do not host, store, upload, or maintain original video files, media content, or underlying database assets on our servers.
Our platform aggregates publicly available links and promotional preview clips ("reels") from third-party websites across the internet. To deliver a seamless user interface, our technology may employ URL rewriting, proxying, or technical routing mechanisms that present third-party web addresses under our domain structure.
Please note:
- No Content Hosting: The use of URL rewriting or proxying does not constitute local hosting, copying, or permanent storage of the underlying media file on our servers.
- Dynamic Fetching: All streamed media content is fetched dynamically in real time from independent, third-party remote servers beyond our direct ownership or control.
- Effect of Takedown: Because we do not store the underlying files, removing a URL rewrite, link, or reel from our directory only disables access via our platform; it does not remove or delete the file from the third-party host hosting it.
2. Designated Copyright Agent
All copyright notices, takedown requests, and counter-notices regarding content indexed on xxxscroll.com or ad creatives displayed via xxxscroll.com/ads must be sent to our Designated Copyright Agent:
- Designated Copyright Agent: DMCA Compliance Officer
- Email: [email protected]
- Subject Line: DMCA Takedown Notice - [Content Title/URL]
3. Submitting a DMCA Takedown Notice
If you are a copyright owner (or an authorized agent representing a copyright owner) and believe that content indexed on our Site infringes upon your copyright, you may submit a written notice.
To ensure your request can be processed efficiently, your DMCA notice must contain the following information:
- Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or a representative list of such works if multiple items are covered.
- Identification of the Infringing Material: The exact URL(s) or deep link(s) on xxxscroll.com where the material is being displayed or indexed, so we can locate and remove the reference.
- Contact Information: Your full legal name, physical mailing address, telephone number, and email address.
- Statement of Good Faith: The following statement:
"I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law." - Statement of Accuracy & Authorization: The following statement:
"I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed." - Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Important Note: Incomplete notices or submissions missing essential details may delay our ability to process your request.
4. Takedown Actions & Index Removal
Upon receiving a valid and complete DMCA notice at [email protected]:
- We will review the submission promptly.
- If valid, we will remove or disable access to the link, embedded player, or ad creative on xxxscroll.com.
- Where applicable, we will notify the third-party source or advertiser that access to the material has been disabled.
Because video files are hosted on external third-party servers, removing a link from xxxscroll.com does not delete the video from the host server itself. Copyright owners are advised to also submit takedown requests directly to the web host storing the source video.
5. Counter-Notification Procedure
If you believe that your content or advertisement was removed or disabled by mistake or misidentification, you may submit a formal Counter-Notification to our Designated Agent containing:
- Identification of Removed Material: The specific URL(s) of the material before it was removed or disabled.
- Contact Details: Your full legal name, address, telephone number, and email address.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the court in your local legal territory or the venue where the platform operates, and that you will accept service of process from the original complaining party.
- Statement under Penalty of Perjury: The following statement:
"I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification." - Signature: Your physical or electronic signature.
Upon receipt of a valid counter-notice, we will forward a copy to the original complaining party. If the copyright owner does not file a court action seeking a restraining order within 10–14 business days, we may restore the link or advertisement.
6. Repeat Infringer Policy
In accordance with DMCA regulations and international safe harbor standards, xxxscroll.com maintains a strict repeat infringer policy.
- Advertisers: Advertiser accounts (xxxscroll.com/ads) that repeatedly submit infringing ad creatives or link to copyright-infringing landing pages will face permanent suspension, account termination, and forfeiture of unused balances.
- External Sources: We reserve the right to permanently block entire external domains or host IPs from our indexing engine if they consistently serve infringing or unauthorized media.
7. Misrepresentation Warning
Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that online material is infringing—or that material was removed by mistake—may be subject to legal liability, including court costs and attorneys' fees incurred by us or the affected user.
